The Kansas Attorney General’s Office said a federal judge has ruled against a Biden Administration rule that would have provided health plans for undocumented immigrants. Kansas was among 19 states that challenged the rule.
The regulation would have made more than 200,000 deferred action for childhood arrival (DACA) recipients eligible for the Affordable Care Act. The number includes more than 4,350 DACA recipients in Kansas.
Attorneys general from Kansas and other states argued that a 1996 law generally prohibits illegal aliens from receiving federal benefits, and the Affordable Care Act itself says that an alien has to be lawfully present in the United States to receive subsidized health insurance.
Missouri, Arkansas, Nebraska and Texas were among the other states that challenged the rule.
