Augusta man sentenced in Wichita sexual assault

An Augusta man has been sentenced to almost 26 years in prison for a sexual assault that happened in 2007 in southeast Wichita.

A sentence of 310 months was given to 54-year-old Ted Foy.   He had entered a guilty plea on March 20th to aggravated criminal sodomy, rape, aggravated sexual battery, and attempted rape.  The plea agreement also called for Foy to disclose how he chose his victim and how he knew where she lived.

Prosecutors said Foy wore all-black clothing and a black mask when he entered the woman’s home through a downstairs window.   He committed the assault while the woman’s husband was away serving in the military.

Foy’s arrest in May of last year was the first for the Wichita Police Department using investigative genetic genealogy in which a DNA sample from an unsolved case is matched to data people have submitted to genealogy websites. Foy’s identity was confirmed through DNA that he left on the victim’s body.
