Kansas Attorney General files lawsuit over new ATF rule

Kansas Attorney General Kris Kobach and 20 other attorneys general have filed a lawsuit to challenge a new federal rule on the sale of firearms.

The rule from the Department of Alcohol, Tobacco and Firearms  would require a federal firearms dealer license for every individual who sells a firearm for anything the ATF sees as a profit, including currency, exchange of another firearm, or a service.

Kobach said the rule would prevent law-abiding citizens from privately selling firearms, and he said “It could make a felon of a gun hobbyist who sells a firearm to another family member or a of hunter who trades a firearm with another hunting buddy.”

In a lawsuit filed in federal court in Arkansas, the attorneys general argue that the rule is unconstitutional, because it is vague, violates the Second Amendment, and circumvents Congress.   Other states involved in the lawsuit include Oklahoma, Nebraska, Missouri, Arkansas, Texas, and Iowa.
