Second lawsuit filed over patient assaults at Wichita hospital

A Wichita law firm has announced that it has filed another lawsuit on behalf of a second patient who was sexually assaulted inside a Wichita hospital.

The Hutton & Hutton Law Firm announced the lawsuit on behalf of an 82-year-old cancer patient who was assaulted on June 15th.   The firm had earlier filed a lawsuit for another patient who was assaulted in June.

Police arrested 28-year-old Miguel Rodela for reported assaults on three patients at Ascension Via Christi St. Francis.    Rodela was charged in Sedgwick County District Court with four counts of rape and two counts of battery.  He was arrested on June 15th after a security guard called 911 to report that a man had sexually assaulted patients and then got into a struggle with a security guard.    Rodela is in jail on a $250,000 bond.

In the latest lawsuit, it is alleged that Rodela entered the hospital just after midnight on June 15th wearing a t-shirt and basketball shorts.  After allegedly raping a patient on the 8th floor, he went to the second victim’s room on the 7th floor.   Rodela’s actions were interrupted by a nurse technician, who then notified a nurse.  The nurse saw Rodela leaving a bathroom across the hall, and he pointed to the second patient’s room and told the nurse that the patient was bleeding.   Rodela was later caught on the 6th floor, in a third patient’s room.

The lawsuit was filed against Ascension Via Christi Hospitals Wichita, Inc.
